These Terms and Conditions ("Terms") govern your enrolment in and use of the SMS/MMS messaging program (the "Program") operated by EHPlabs LLC ("EHPlabs," "we," "us," or "our") for participants in the EHPlabs US Creator Program. 1. Program Description

The Program delivers SMS and MMS messages to enrolled EHPlabs creators regarding creator competitions and challenges, sales and promotions, Discord community events, webinars, training sessions, sampling notifications, and other program updates.

2. Consent to Receive Messages

By providing your mobile phone number and opting in to the Program, you expressly consent to receive recurring automated marketing and informational text messages from EHPlabs at that number, sent using an automatic telephone dialing system or similar technology.

Consent to receive text messages is not a condition of purchase of any goods or services.

You confirm that you are the account holder of the mobile number provided, or that you have the account holder's permission to enrol the number in the Program.

3. Eligibility

You must be at least 18 years of age and a resident of the United States to participate in the Program. The Program is not intended for use outside of the United States, and messages are only delivered to US mobile numbers on supported carriers.

4. Message Frequency

Message frequency varies. You can expect to receive up to 8 messages per month, depending on Program activity, campaign timing, and event schedules.

5. Message and Data Rates

Message and data rates may apply. Standard messaging and data charges from your mobile carrier apply to all messages you send and receive as part of the Program. EHPlabs is not responsible for any charges imposed by your mobile carrier. Contact your carrier for details of your messaging and data plan.

6. How to Opt Out (STOP)

You may cancel your enrolment in the Program at any time by texting STOP to the number from which you received our message. After you send STOP, we will send you a single confirmation message and you will not receive further messages from the Program. If you wish to rejoin, you must sign up again through the original enrolment process.

8. Supported Carriers

The Program is available on major US mobile carriers, including AT&T, Verizon, T-Mobile, Sprint, US Cellular, Boost Mobile, MetroPCS, Cricket Wireless, and Virgin Mobile, subject to change. Not all carriers are supported, and messages may not be deliverable in all areas.

Carriers are not liable for delayed or undelivered messages.

9. No Guarantee of Delivery

We do not guarantee that any message will be delivered to, or received by, you. Message delivery depends on your mobile device, your carrier's network, and other factors outside our control. EHPlabs is not responsible for any delayed, misdirected, or undelivered messages.

10. Changes to the Program

We reserve the right to modify, suspend, or terminate the Program, in whole or in part, at any time and without prior notice. We also reserve the right to modify these Terms at any time. Material changes will be communicated through the Program (for example, via SMS notification or by updating the effective date above). Your continued enrolment in the Program after changes take effect constitutes acceptance of the updated Terms.

11. Privacy

Your enrolment in the Program is subject to our SMS Program Privacy Policy, available at https://ehplabs.com/pages/tiktok-shop-creator-sms-policy, which describes how we collect, use, and protect information you provide. Mobile phone numbers will not be shared with third parties or affiliates for marketing or promotional purposes.

12. Prohibited Conduct

You agree not to use the Program to transmit unlawful, harassing, defamatory, obscene, or otherwise objectionable content, or to interfere with the operation of the Program. We reserve the right to remove any participant from the Program at our discretion.

13. Intellectual Property

All content delivered through the Program, including text, graphics, logos, and images, is the property of EHPlabs or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Program content without our prior written consent, except as necessary for your ordinary participation in the EHPlabs US Creator Program.

14. Disclaimer of Warranties

The Program is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, EHPlabs disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, EHPlabs, its affiliates, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your enrolment in or use of the Program, including any charges imposed by your mobile carrier or any delayed, undelivered, or misdirected messages.

16. Indemnification

You agree to indemnify and hold harmless EHPlabs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the Program.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
